The
Clean Neighbourhoods and Environment Act 2005
(new window) gives additional powers to parish and town
councils to control litter, graffiti, flyposting and dogs. It
allows them to issue fixed penalty notices, and retain the
receipts.
The Department for the Environment, Food and Rural Affairs
(Defra) has produced a guide for parish and town councils to assist
them to decide whether they wish to use the powers available to
them, and describes good practice in their implementation.

It is recognised that the additional powers are not going
to be right for every parish council. The guide offers detailed
guidance on how they can be used and should leave each parish well
placed to decide what powers they want to adopt and how they can go
about using them.

issue fixed penalty notices on behalf of a parish council. There
are also example of forms that could be used by town and parish
councils.
