Kesgrave and Rushmere boundary review

On 6 May 2003 Suffolk Coastal District Council received a request for a boundary change from residents in Yewtree Grove. As a result of this request a report was submitted to Full Council on 28 October 2004 (Report CL 24/04) seeking permission to carry out the boundary review between Kesgrave and Rushmere St Andrew in the Yewtree Grove area which, was approved.

The first part of the review was to undertake a consultation exercise with all parties that would be affected by the proposed change. The initial consultation exercise was carried out in July 2005, the findings of the review were presented to Full Council on 27 October 2005 (Report CL 17/05) where Council resolved to move the boundary between Kesgrave and Rushmere St Andrew.

This recommendation was then submitted to the Secretary of State for their consideration. At this time under the Local Government and Rating Act 1997 the Secretary of State held the power to create and seal the order.

In December 2007 the Council received a letter from the Department for Communities and Local Government informing us that previous legislation that parish boundary reviews were undertaken under (the Local Government and Rating Act 1997) had been superseded by a new Act, the Local Government and Public Involvement Act 2007. The new Act devolved the Secretary of State's decision making power to principal councils for community governance (parish) review and petition cases.

In November 2008 the Kesgrave and Rushmere St Andrew review case was formally transferred back to the Council to take a decision. A report was submitted to Full Council on the 25 June 2009 (Report CL 08/09) asking Council to decide whether to accept the recommendations made under the original 2005 review case or give approval for a new community governance review to be undertaken in the Yewtree Grove area.

Full Council resolved to accept the recommendations made under the original 2005 review case:

Therefore transferring the areas of land hatched blue and marked with the letters A and B on the plan below from the parish of Kesgrave to the parish of Rushmere St Andrew.

The reason for the change was to bring all properties in Yewtree Grove within the same parish as per the resident's request. This change was implemented on 1 April 2010.
