Controlling anti-social drinking in public places - Wickham Market, Saxmundham and Kelsale-cum-Carlton

Designated public place signThe police are set to be given the additional powers to control anti-social drinking through the introduction of alcohol designation orders in parts of Wickham Market, Saxmundham and Kelsale-cum Carlton.

The town and parish councils of these areas have recognised the need to give the police the authority to take action against those who are drinking in public and acting anti-socially. A list of the proposed designated areas is given below.
 
A meeting of the Council's Cabinet on 3 June gave its go-ahead to the proposals and these were officially backed by Full Council on 26 June. The orders came into force on 18 August 2008.

These orders are not intended as being a ban on everyone drinking in these places, but it gives the police the authority to take action against those who fuelled by alcohol are acting in an anti-social manner.

In the designated areas the police have the power to require someone whose behaviour is deemed to be anti-social to stop drinking the alcohol, and if requested, hand over the drink. Failure to do so is an arrestable offence, with a potential fine of up to £500.

Wickham Market

The order that applies is officially called the Alcohol Consumption in Designated Public Places (Wickham Market) Order (No.1) 2008.

The order applies to:

The Hill, Dallinghoo Road up to No. 3, the car park, the playing field including the bowling green, skateboard park, playground, the car park and access road to the High Street. The High Street between No 61 and the Hill, The War Memorial car park and public areas around the Medical Centre, Resource Centre and Richard Kitson Court. Chapel Lane up to Mill Lane. The access to All Saints Church and its churchyard, Crown Lane and the High Street between the Hill and No 91.

Saxmundham

The order that applies is officially called the Alcohol Consumption in Designated Public Places (Saxmundham) Order (No.1) 2008.

The order applies to:

Church Hill from Manor Gardens, Church Road, Chantry Road, Chantry Road Play Area, Mill Road, Rendham Road, to the junction with Brook Farm Road, Haywards Mews, Fromus Square, High Street, North Entrance up to and including Lambsale Meadow, Harpers Lane, Fairfield Road, St. Johns Road, Chapel Road, Albion Street, New Cut, Station Approach, Market Place including the car park, Somerfield supermarket car park, and Street Farm Road.

The War Memorial Playing Field and Play Area. Seaman Avenue and the footpath between Mill Road and Seaman Avenue.

The footpath between Harpers Lane and Henley Close, Henley Close, the footpath between Henley Close and Brook Farm Road, and between Fairfield Road and Henley Close.

Brook Farm Road between Dove Close and Ashfords Close, Carlton Park Sports and Recreation Club. The open space at the rear of Ashfords Close and Tennyson Road.

Kelsale-cum-Carlton

The order that applies is officially called the Alcohol Consumption in Designated Public Places (Kelsale-cum-Carlton) Order (No.1) 2008.

The order applies to:

The Churchyards at St Mary and St Peter, Kelsale, and St Peter Carlton. The Bus shelters located on B1121 opposite Beaumont Cottages. Kelsale Recreation Ground including the Play Area. Carlton Green including the Play Area. The two open space play areas in Beaumont Cottages. Kelsale Village Centre Car Park, and Bridge Street from the car park to the Old Forge, Kelsale.

It should be noted that the order only relates to public places but not to:

  • Any premises to which a premises licence or a club premises certificate under the Licensing Act 2003 applies or the curtilage thereof;
  • Any premises which by virtue of Part 5 of the Licensing Act 2003 may for the time being be used for the supply of alcohol or could have been so used within the last twenty minutes;
  • Any place where facilities relating to the sale or consumption of alcohol are permitted under Section 115 E Highways Act 1980.
